Terms of Service

These Terms of Service ("Terms") govern your access to and use of the SmartCABuddy practice-management application and the www.smartcabuddy.com website (together, the "Service"). By creating an account or using the Service, you agree to these Terms.

1. The Service

SmartCABuddy is a software-as-a-service application that helps Chartered Accountancy firms manage clients, engagements, deadlines, fees, documents, team workflows and reports. We may update, improve or change features over time.

4. Acceptable use

You agree not to: (a) reverse engineer or resell the Service; (b) interfere with its operation or security; (c) use it to send spam or malware; or (d) use it in violation of applicable law. We may suspend access for conduct that threatens the Service or other users.

5. Fees

During the launch period the Service may be offered free or on a trial basis. When paid plans are introduced, applicable fees, billing cycles and the Refund & Cancellation Policy will be published before you are charged, and continued use will be subject to them.

6. Availability & support

We aim for high availability but do not guarantee uninterrupted service. We may perform maintenance, and may modify or discontinue features. Support is provided by email and WhatsApp on a reasonable-efforts basis.

7. Intellectual property

The Service, including its software, design and branding, is owned by SmartCABuddy and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while your subscription is active. Customer Content remains yours.

8. Confidentiality & security

We treat your Customer Content as confidential and protect it as described in our Privacy Policy and Data Security page.

9. Termination

You may stop using the Service and request closure of your account at any time. We may suspend or terminate access for material breach of these Terms. On termination, we will handle your data as described in the Privacy Policy; you may request an export of your Customer Content within a reasonable period before deletion.

10. Disclaimers

The Service is a tool to help you manage your practice. It does not provide tax, accounting, legal or professional advice, and is not a substitute for your professional judgement or for filing with any authority. The Service is provided "as is" and "as available" without warranties of any kind to the extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, SmartCABuddy will not be liable for indirect, incidental, special or consequential damages, or for loss of profits, data or goodwill. Our total liability arising out of or relating to the Service will not exceed the amount you paid to us for the Service in the twelve months before the claim (or, during any free period, a nominal amount).

12. Governing law

These Terms are governed by the laws of India, and the courts at Kapurthala, Punjab will have exclusive jurisdiction, subject to applicable law.

13. Changes

We may update these Terms. We will post the revised version here with a new "Last updated" date and, where appropriate, notify you in the application. Continued use after changes means you accept the updated Terms.
